General Terms of Use of the Site and the Services Offered

The use of the site implies full and complete acceptance of the general terms of use described below. These terms of use may be modified or supplemented at any time, so users of the site are invited to consult them regularly.

This site is normally accessible to users at any time. An interruption for technical maintenance reasons may however be decided by EXP4, who will then endeavor to communicate to users beforehand the dates and times of the intervention.

The site is updated regularly by EXP4. In the same way, the legal notices can be modified at any time: they are nevertheless imposed on the user who is invited to refer to them as often as possible in order to become aware of them.

Description of Services Provided

The purpose of the site is to provide a solution for article writing.

EXP4 endeavors to provide the site with information that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies, and deficiencies in the update, whether by its own doing or by the third-party partners who provide this information.

All the information indicated on the site is given for information purposes only and is subject to change. Furthermore, the information on the site is not exhaustive. It is given subject to modifications having been made since they were put online.

Contractual Limitations on Technical Data

The site uses JavaScript technology.

The website cannot be held responsible for material damage related to the use of the site. In addition, the user of the site undertakes to access the site using recent equipment, not containing viruses and with a latest-generation, up-to-date browser.

Intellectual Property and Counterfeiting

EXP4 owns the intellectual property rights or holds the usage rights for all elements accessible on the site, including texts, images, graphics, logos, icons, sounds, and software.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited, except with prior written authorization from EXP4.

Any unauthorized use of the site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code.

Limitations of Liability

EXP4 cannot be held responsible for direct and indirect damage caused to the user’s equipment when accessing the site, resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

EXP4 cannot also be held responsible for indirect damage (such as a loss of market or loss of opportunity) resulting from the use of the site.

Interactive spaces (possibility to ask questions in the contact area) are available to users. EXP4 reserves the right to delete, without prior notice, any content posted in this space that would violate applicable legislation in France, in particular the provisions relating to data protection. If applicable, EXP4 also reserves the possibility of questioning the civil and/or criminal liability of the user, especially in the event of a message of a racist, insulting, defamatory, or pornographic nature, regardless of the medium used (text, photography…).

Management of Personal Data

In France, personal data is notably protected by law no. 78-87 of January 6, 1978, law no. 2004-801 of August 6, 2004, article L. 226-13 of the Penal Code, and the European Directive of October 24, 1995.

On the occasion of using the site, the following may be collected: the URL of the links through which the user accessed the site, the user’s access provider, the user’s Internet Protocol (IP) address.

In any case, EXP4 only collects personal information about the user for the need of certain services offered by the site. The user provides this information with full knowledge of the facts, especially when proceeding by himself/herself to their input. It is then specified to the user of the site the obligation or not to provide this information.

In accordance with the provisions of articles 38 and following of law 78-17 of January 6, 1978, relating to information technology, files, and freedoms, every user has a right of access, rectification, and opposition to personal data concerning him/her, by making a written and signed request, accompanied by a copy of the identity document with signature of the holder of the document, specifying the address to which the reply should be sent.

No personal information of the user of the site is published without the user’s knowledge, exchanged, transferred, assigned, or sold on any medium to third parties. Only the assumption of the purchase of EXP4 and its rights would allow the transmission of said information to the potential buyer who would in turn be held to the same obligation of conservation and modification of data concerning the user of the site.

The site is not declared to the CNIL as it does not collect personal information.

The databases are protected by the provisions of the law of July 1, 1998, transposing directive 96/9 of March 11, 1996, on the legal protection of databases.

The site contains a number of hyperlinks to other sites, set up with the authorization of EXP4. However, EXP4 does not have the possibility to check the content of the sites thus visited, and will not assume any responsibility for this fact.

Applicable Law and Jurisdiction

Any dispute in connection with the use of the site is subject to French law. Exclusive jurisdiction is attributed to the competent courts of Paris.
